Tampa Tractor Trailer Underride Accidents

There are many types of tractor trailer accidents, but the most devastating are underride accidents which usually result in serious injury or death. If you or a loved one has been involved in an underride accident, contact the Capaz Law firm to speak with an experienced truck accident attorney now.

What is an Underride Accident?

An underride accident occurs when a vehicle goes underneath a tractor trailer, either from behind or from the side. An underride is most dangerous when the vehicle goes completely underneath the tractor trailer. When this happens, the vehicle’s roof can get crushed or completely removed on impact, often causing death to those inside the vehicle.

However, sometimes tractor trailers have underride barriers which prevent the vehicle from going completely underneath. In these accidents, the vehicle’s occupants are more likely to survive but may still suffer serious injury.

What Causes Underride Accidents?

There are many circumstances that cause underride accidents such as bad weather, poor visibility or multicar pileups. However, oftentimes these accidents are caused when the driver of a tractor trailer is negligent or fails to follow federal safety regulations.

Side underride accidents may occur when a truck is making a turn that obstructs other lanes of traffic or when the truck changes lanes and runs over the smaller vehicle.

Rear underride accidents may occur when a tractor trailer is broken down and is not using reflective triangles to warn oncoming traffic. A collision may also occur if the tractor trailer is driving too slowly without using emergency flashers. In these instances, other vehicles may not notice that the tractor trailer has slowed down or stopped until it is too late. At night, a vehicle may collide with the back of a tractor trailer if the trailer’s taillights are faulty or are not clearly visible.

Who is Liable for an Underride Accident?

An experienced tractor trailer accident attorney can investigate the circumstances of an underride accident and determine who may be held liable. There may be several at-fault parties including the truck driver, the driver’s employer or other party depending on what caused the accident.
